The building owner proposing the construction work is responsible for initiating the Party Wall Agreement process. They must serve their neighbours with a Party Wall Notice, informing them of the intended work.
The primary parties involved include the building owner initiating the work and the adjoining property owners who share the party wall. In some cases, a third-party surveyor may also be involved in dispute resolution.
To serve a Party Wall Notice, you need to provide written notice to your neighbours, detailing the proposed work, its potential impact, and a schedule for commencement. The notice should be served at least two months before the scheduled work.
If your neighbour disagrees with or does not respond to the Party Wall Notice within 14 days, a dispute is considered to have arisen. Both parties may then appoint their surveyors or agree on a single “agreed surveyor” to resolve the dispute.
Not all Party Wall Agreements necessitate the involvement of a surveyor. If both parties agree to the proposed work’s terms and its effects on the shared wall or boundary, a surveyor may not be necessary. However, a surveyor can help ensure an impartial and fair agreement.
